1. Acceptance of Terms

1.1 Agreement to Terms

By accessing and utilizing our website and services, you explicitly acknowledge your understanding, acceptance, and full agreement with the stipulations laid out in these comprehensive Terms of Service ("Terms"). The terms "Pythbots," "we," "us," or "our" refer to Digisivu, operating under the brand name Pythbots, and its encompassing services.

2. Service Usage

2.1 Eligibility and Proper Conduct

2.1.a Age Requirements and Parental Consent

Our services are intended for users who are 18 years of age or older. If you are under 18, you may only use our services with the express permission and ongoing supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf. By using our services, you confirm that you meet these age requirements or have obtained the necessary parental consent.

2.1.b Prohibited Conduct

You are strictly prohibited from using our services to engage in, facilitate, or encourage any illegal activities, including but not limited to: harassment, discrimination, threats, fraud, distribution of malicious software, unauthorized access to systems, or any activity that violates applicable laws or regulations. This includes any content or behavior that is defamatory, obscene, pornographic, or otherwise objectionable.

2.1.c Account Registration Requirements

When creating an account, you must provide complete and accurate information, including a valid email address and any other required details. You are responsible for maintaining the accuracy of this information and keeping it up to date. Providing false or misleading information may result in immediate termination of your account and access to our services.

2.1.d Account Security

You are solely responsible for maintaining the confidentiality of your account credentials. Our personnel will never request your password under any circumstances.

2.1.e Data Collection

Our services employ cookies and similar tracking technologies to enhance user experience and service functionality. By using our services, you consent to our use of cookies in accordance with our Privacy Policy.

2.1.f User Management

We maintain the right to monitor and manage user activities to ensure compliance with our terms. This may include maintaining records of users who violate our policies.

2.1.g Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of our service at any time, with or without notice, including the availability of any feature or content.

2.1.h Third-Party Services and Dependencies

Our service operates in conjunction with various third-party platforms, including but not limited to xat.com. These services are entirely independent of Pythbots, and we exercise no control over their operations, availability, or content. You acknowledge and agree that Pythbots shall bear no responsibility or liability for any issues, damages, or losses arising from or related to these third-party services, including but not limited to service interruptions, data loss, or security breaches.

2.1.i Prohibited Activities and Enforcement

You expressly agree not to engage in, attempt to engage in, or assist others in engaging in any of the following activities, all of which are strictly prohibited under these Terms:

• Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code of any part of our service
• Modifying, adapting, translating, or creating derivative works based on our service
• Removing, altering, or obscuring any proprietary notices or labels on our service
• Using any automated system, including but not limited to robots, spiders, or offline readers, to access or interact with our service in a manner that sends more request messages to our servers than a human could reasonably produce in the same period
• Interfering with or disrupting the integrity or performance of our service or the data contained therein
• Attempting to gain unauthorized access to our service, computer systems, or networks connected to our service through hacking or any other means

Violation of these prohibitions may result in immediate termination of your account and may subject you to civil and criminal liability.

2.2 API Access, Usage Limits, and Abuse Prevention

Any use of the Pythbots API (including public and private endpoints) must be lawful, fair, and consistent with these Terms. You may only use the API for legitimate integration purposes and must follow all published technical and usage requirements.

2.2.a Prohibited API Abuse

The following conduct is strictly prohibited: excessive or abusive request volume; intentional overload attempts; denial-of-service behavior; brute-force requests; automated scraping beyond permitted use; bypassing authentication, authorization, or rate limits; key sharing; key resale; unauthorized endpoint discovery; and any attempt to disrupt, degrade, or reverse engineer API infrastructure.

2.2.b API Credentials and Key Security

You are solely responsible for protecting API credentials, personal keys, and tokens issued to your account. You must not expose keys in client-side code, public repositories, shared files, or third-party services without adequate protection. Any activity performed using your credentials is deemed your responsibility.

2.2.c Monitoring, Rate Limiting, and Enforcement

Pythbots may monitor API traffic, impose or modify rate limits, throttle requests, suspend or revoke API access, rotate or invalidate credentials, and block IP addresses or accounts at any time to prevent abuse, maintain service stability, or enforce these Terms. We are not liable for losses, interruptions, or data impacts resulting from enforcement actions or abuse mitigation controls.

3. Account Management and Security

3.1 Account Responsibility and Liability

You bear sole responsibility for all activities conducted through your account, whether authorized by you or not. You agree to immediately notify Pythbots of any unauthorized use of your account or any other breach of security. Pythbots shall not be liable for any loss or damage arising from your failure to comply with these security obligations.

3.2 Strict Prohibition on Account Sharing

Account sharing, lending, transferring, or selling is strictly prohibited. Each account may only be used by the individual or entity that registered it. Any unauthorized access or use of accounts is a material breach of these Terms and may result in immediate termination of the account without refund.

3.3 Account Inactivity and Termination

Pythbots reserves the unconditional right to suspend, terminate, or delete any account and its data that remains inactive for a period of 14 days or more. For the avoidance of doubt, "inactivity" includes but is not limited to failure to log in, failure to use paid services, or failure to respond to communications from Pythbots. No refunds shall be provided for any unused services or credits in terminated accounts.

3.4 Right to Monitor and Investigate

Pythbots reserves the right, but not the obligation, to monitor, record, and investigate any and all activities conducted through the service. You hereby consent to such monitoring and recording. We may disclose any information as necessary to satisfy any law, regulation, or governmental request, or to protect our rights or property.

3.5 ID Ownership Changes, Access Loss, and Data Transfer Policy

If you sell, give away, transfer, or otherwise lose control of any ID registered with xat.com, Pythbots will not transfer any data, services, balances, or account-related assets from that ID to any other ID. We are not responsible for any data exposure, loss, or unauthorized use resulting from your sale, transfer, sharing, or loss of access to an ID.

You must request data removal before providing or allowing possible access to another person. For avoidance of doubt, Pythbots does not transfer data from one ID to another ID under any circumstances.

3.6 Personal Key Responsibility and Non-Sharing Policy

Each user is solely responsible for the security, confidentiality, and use of their personal key. Sharing, disclosing, lending, or otherwise providing your personal key to any other person is strictly forbidden under any circumstance.

Pythbots is not responsible for any leaked, exposed, altered, or deleted data, or any resulting loss, caused by your failure to secure your personal key or by unauthorized access involving your personal key.

4. Financial Terms and Conditions

4.1 Payment Processing and Authorization

All payments for Pythbots services must be made through approved payment channels, primarily via virtual credits (xats and days) on xat.com. By initiating a payment, you authorize us to charge the applicable fees to your chosen payment method. Pythbots reserves the exclusive right to modify, add, or remove payment methods at any time without prior notice.

4.2 No Refund Policy

ALL PAYMENTS MADE TO PYTHBOTS ARE FINAL AND NON-REFUNDABLE, except as required by applicable law. This includes, but is not limited to, monthly subscription fees, one-time payments, and any other service fees. Pythbots makes NO GUARANTEES regarding the availability, quality, or functionality of any service, and no refunds will be issued for service interruptions, terminations, or modifications.

4.3 Price Modifications

Pythbots reserves the right to modify pricing for any service at any time. Price changes will be effective immediately upon posting on our website or notifying users via email. Continued use of the service after such changes constitutes your acceptance of the new pricing.

5. Comprehensive Limitation of Liability

5.1 Service "As Is" and "As Available"

PYTHBOTS PROVIDES THE SERVICE ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PYTHBOTS EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM PYTHBOTS SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

5.2 No Liability for Damages

IN NO EVENT SHALL PYTHBOTS, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; OR (V) SECURITY INCIDENTS, DATA BREACHES, CREDENTIAL COMPROMISES, ACCOUNT TAKEOVERS, MALICIOUS ACTS, OR DATA LOSS EVENTS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT PYTHBOTS HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

5.3 Cap on Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PYTHBOTS SHALL NOT BE LIABLE TO YOU FOR MORE THAN THE GREATER OF (A) THE TOTAL AMOUNT PAID TO PYTHBOTS BY YOU DURING THE TWELVE-MONTH PERIOD PRIOR TO THE ACT, OMISSION, OR OCCURRENCE GIVING RISE TO SUCH LIABILITY; OR (B) THE AMOUNT OF $100.00 USD. THE FOREGOING LIMITATIONS WILL APPLY WHETHER SUCH DAMAGES ARISE OUT OF BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE AND REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR PYTHBOTS WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

5.4 Essential Basis of the Bargain

YOU ACKNOWLEDGE AND AGREE THAT PYTHBOTS HAS OFFERED ITS SERVICES AND ENTERED INTO THESE TERMS IN RELIANCE UPON THE WARRANTY DISCLAIMERS AND THE LIMITATIONS OF LIABILITY SET FORTH HEREIN, THAT THE WARRANTY DISCLAIMERS AND THE LIMITATIONS OF LIABILITY SET FORTH HEREIN REFLECT A REASONABLE AND FAIR ALLOCATION OF RISK BETWEEN YOU AND PYTHBOTS, AND THAT THE WARRANTY DISCLAIMERS AND THE LIMITATIONS OF LIABILITY SET FORTH HEREIN FORM AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN YOU AND PYTHBOTS. PYTHBOTS WOULD NOT BE ABLE TO PROVIDE THE SERVICE TO YOU ON AN ECONOMICALLY REASONABLE BASIS WITHOUT THESE LIMITATIONS.

The service is provided "as is" without warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose.

5.5 Security Warranty Disclaimer and No Guaranteed Recovery

While Pythbots may implement reasonable technical and organizational safeguards, no platform, system, network, or transmission method is completely secure. Pythbots does not warrant that the service will be uninterrupted, error-free, fully secure, immune from attack, or free from unauthorized access attempts.

You are solely responsible for maintaining your own backups and recovery copies of any data you submit, store, process, or access through the service. Pythbots does not guarantee restoration, recovery, or reconstruction of lost, corrupted, encrypted, deleted, or otherwise unavailable data.

6. User Security Duties and Incident Cooperation

6.1 User Security Obligations

You agree to maintain reasonable security controls over your devices, software, credentials, API keys, personal keys, integrations, and access channels, including use of strong unique secrets, prompt software updates, and secure storage practices. You must immediately notify Pythbots of any known or suspected unauthorized access, credential compromise, or security incident involving your account or integrations.

6.2 Incident Cooperation

In the event of a suspected or actual security incident, you agree to cooperate in good faith with reasonable investigation and mitigation requests, including temporary access restrictions, key rotation, account verification steps, and relevant technical disclosures necessary to contain abuse or prevent further damage.

7. Security Incidents and Breach Communications

7.1 Incident Handling and Notifications

Pythbots may investigate, contain, and remediate security events at its discretion and according to operational and legal requirements. Any incident-related communications or notifications will be provided in a manner and timeframe that Pythbots determines appropriate and compliant with applicable law. Nothing in these Terms creates a separate contractual notification deadline beyond obligations imposed by law.

7.2 Preventive and Emergency Measures

To protect the service and users, Pythbots may take immediate preventive actions, including account suspension, API key invalidation, rate throttling, or service isolation, without prior notice. Pythbots will not be liable for losses resulting from reasonable emergency security measures.

8. Indemnification

You agree to defend, indemnify, and hold harmless Pythbots, its directors, officers, employees, agents, contractors, and affiliates from and against any and all claims, demands, actions, liabilities, damages, judgments, settlements, penalties, fines, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (i) your use or misuse of the service or API; (ii) your breach of these Terms; (iii) your negligence, fraud, willful misconduct, or violation of law; (iv) your credential, key, token, or account compromise; (v) your content, integrations, or data practices; or (vi) any claim that your conduct infringes or violates the rights of a third party.

9. Force Majeure and Third-Party Infrastructure

Pythbots will not be liable for any delay, interruption, degradation, or failure in performance caused by events beyond its reasonable control, including but not limited to natural disasters, war, terrorism, civil disturbances, labor disputes, power or internet outages, cloud provider failures, hosting incidents, DNS disruptions, CDN failures, payment processor outages, third-party platform failures (including xat.com), governmental actions, or large-scale cyberattacks.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. Your continued use of the service following any changes constitutes acceptance of those changes.

11. Dispute Resolution, Claim Limits, and Governing Law

11.1 Time Limit to Bring Claims

To the maximum extent permitted by applicable law, any claim or cause of action arising out of or related to the service or these Terms must be filed within twelve (12) months after the claim arose; otherwise, such claim is permanently barred.

11.2 Informal Resolution First

Before initiating formal proceedings, you agree to contact Pythbots and attempt in good faith to resolve the dispute informally for at least thirty (30) days.

11.3 Arbitration, Venue, and Class Action Waiver

Except where prohibited by applicable law, disputes that cannot be resolved informally shall be resolved by binding arbitration or, where arbitration is unavailable, by the competent courts of Pythbots' principal place of business. You agree to bring claims only in your individual capacity and waive any right to participate in class, collective, consolidated, or representative actions, and waive any right to a jury trial where permitted by law.

11.4 Governing Law

These Terms and any dispute arising from them shall be governed by the laws of Finland, without regard to conflict-of-law principles, unless mandatory consumer protection laws in your jurisdiction require otherwise.

12. No Security, Legal, or Compliance Guarantee

Pythbots does not provide legal, regulatory, cybersecurity certification, or compliance advisory services through the platform. You remain solely responsible for your own legal obligations, regulatory compliance, and data governance requirements, including but not limited to privacy, retention, and cross-border transfer obligations that may apply to your use case.

13. Privacy Policy Incorporation and Data Handling Priority

Your use of the service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. In case of conflict between these Terms and the Privacy Policy regarding personal data processing disclosures, mandatory legal requirements and the Privacy Policy disclosures control to the extent required by law.

14. Electronic Communications and E-Sign Consent

You consent to receive communications from Pythbots electronically, including by email, website notices, dashboard notices, or API/system responses. You agree that electronic notices, agreements, and records satisfy any legal requirement that such communications be in writing.

15. Assignment and Transfer

You may not assign, transfer, delegate, or sublicense any rights or obligations under these Terms without prior written consent from Pythbots. Pythbots may assign or transfer these Terms, in whole or in part, including in connection with merger, acquisition, reorganization, sale of assets, or operation transfer, without notice or consent where permitted by law.

16. Severability, Waiver, and Entire Agreement

16.1 Severability

If any provision of these Terms is held invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect.

16.2 No Waiver

No failure or delay by Pythbots in exercising any right or remedy shall operate as a waiver. Any waiver must be explicit and in writing.

16.3 Entire Agreement

These Terms, together with any incorporated policies, constitute the complete and exclusive agreement between you and Pythbots regarding the service and supersede prior or contemporaneous agreements, communications, or understandings on the same subject matter.

17. Termination Effects and Survival

Upon suspension or termination of access, your right to use the service ceases immediately. Termination does not relieve you of obligations accrued prior to termination. Provisions that by nature should survive termination shall survive, including but not limited to payment obligations, restrictions on misuse, indemnification, disclaimers, limitations of liability, dispute resolution terms, governing law, claim time limits, and data-related disclaimers.

18. Intellectual Property Complaints and Takedown Process

If you believe content available through the service infringes your intellectual property rights, you may submit a written notice with sufficient detail to identify the work, the allegedly infringing material, and proof of authority. Pythbots may remove, disable, or restrict access to challenged content and may terminate repeat infringers at its discretion. Pythbots may also provide notice of the complaint to the affected user and allow a counter-notice process where appropriate and lawful.

19. Acceptable Use Enforcement and Injunctive Relief

Any actual or threatened misuse of the service, platform security, API infrastructure, or intellectual property may cause irreparable harm for which monetary damages may be insufficient. You agree that Pythbots may seek injunctive or equitable relief, in addition to any other remedies available at law, without requirement to post bond where permitted by law.
